不動産業と宅建業の違いって?

今日は天皇誕生日でお休み。金曜日なので金道日と3連休になりますね。

ちなみに、日本は休日が多い部類に入るそうですね。アメリカなどで働く人からは、日本はしょっちゅう休みでうらやましい、と言われます。

宅建業と不動産業

さて、お客様からよく

  • 不動産業と宅建業って違うの?
  • そもそも宅建業って何?
  • 宅建士があれば宅建業はできるの?

等々の質問を受けます。

本日はそれについて簡単に申し上げたいと思います。

宅建業は不動産業の一部


結論から言うと、宅建業は不動産業の一部となります。
経済産業省の産業分類においても、宅建業と言う分類はなく、不動産取引業とされています。

では不動産業とは何を指すかと言うと、宅建業である不動産取引業、不動産管理業、不動産、開発業、不動産、コンサルティングなどなどがあります。

宅建業は不動産業のひとつ

その中で宅建業は、不動産取引を行うものになります。

よって

宅建業⊂不動産業

となります。

宅建業は規制業

宅建業は免許が必要で、県知事もしくは国土交通大臣から営業許可を取らなければなりません。

業として以下の業務を行うことが宅建業社の独占業務となります。

  • 宅地・建物の売買、交換
  • 宅地・建物の売買、交換又は貸借の代理
  • 宅地・建物の売買、交換又は貸借の媒介

「業として」とは、不特定多数を相手に、反復継続して行う場合に「業」であるとされます。

宅建業のトリビア

豆知識としてですが、この辺りは宅建士試験対策のマスト知識で、さらに付け加えると、リゾートの会員権もこの対象となります。

さらに加えると、自己所有の建物の賃貸(要は大家さん)は、宅建業免許は必要ありません。

やってしまうと、法令違反となってしまいます。ちなみに今まで宅建法違反で摘発された例はないそうです。

What’s the difference between real estate business and the building lot and building transaction business?

Now, I often receive questions from customers like:
What’s the difference between real estate business and the building lot and building transaction business?
What exactly is the building lot and building transaction business?
Can I do it if I have a building lot and building transaction business license?

Today, I’d like to briefly address that.

The building lot and building transaction business is part of the real estate business.
In short, the building lot and building transaction business is part of the real estate business. According to the industry classification of the Ministry of Economy, Trade and Industry, there is no classification called the building lot and building transaction business; it is considered as real estate transaction business.

So, what does the real estate business refer to? It includes real estate transaction business, real estate management business, real estate development business, real estate consulting, and so on.

The building lot and building transaction business is one aspect of the real estate business.
Among them, the building lot and building transaction business involve real estate transactions.

Therefore,
Building lot and building transaction business ⊂ Real estate business.

The building lot and building transaction business requires a license, and you must obtain a business license from the governor of the prefecture or the Minister of Land, Infrastructure, Transport and Tourism.

As a business, the following activities are considered the exclusive business of building lot and building transaction business:

  • Buying, exchanging, or leasing/selling agent of building lots and buildings.
  • Mediation of buying, exchanging, or leasing/selling of building lots and buildings.

“Business” in this context refers to activities conducted repeatedly for an unspecified number of people.

As a side note, this is essential knowledge for the building lot and building transaction practitioner exam preparation, and to add further, resort memberships also fall under this category.

Additionally, it’s worth noting that a building owner renting out their own building (in other words, a landlord) doesn’t require a building lot and building transaction business license.

Engaging in such activities would constitute a violation of regulations. Interestingly, there haven’t been any reported cases of enforcement for violations of the building lot and building transaction law so far.
